Ruling for Motion to Dismiss (Moot Court BPS 4-1)

RESOLUTION. Criminal Case 4-1 - (Journalists, Attorneys, et.al. vs. GRP, NISA) - Considering the allegations, issues and arguments adduced in the Motion to Dismiss, the Court resolves to DENY the Motion to Dismiss for failure to allege reasonable grounds to warrant dismissal.

Adhering to the principle that substantial justice is better served by allowing the Petition on the merits, the Court finds and so holds that the foregoing formal requirements of pleadings under the Rules should be given a liberal interpretation."

WHEREFORE, the Court ORDERS the Respondent to file COMMENT on or before 5:00 PM of September 20, 2008.

SO ORDERED.

Hmmm. anonymous, you are a teaser.

But in fairness to the respondents, the Motion to Dismiss could have been granted, if only I am not avoiding a situation of "winner by technicality."

So, don't take the moot court war so personal please.

1.It will not prosper. It is not part of the jurisdiction of DOJ to file bribery complaint against CA justice.
-No, the DOJ cannot file directly criminal case,under the Doctrine of Exhaustion of Remedies,CA will be the first one to act on it.
criminal case file on Sandiganbayan,
administrative case on Supreme court,IBP
2. it will not prosper, because it must have on due published procedures.
