good side of typhoon "durian" a.k.a. "reming"

Never thought I would somehow appreciate typhoons.

I always make "sermons" if my students were asking if there will be classes during typhoons. My reply would always make them realize that wishing for typhoons will mean thousand of families will lose homes and even it may take lives.

What I appreciate now was that typhoon "Durian" a.k.a. "Reming" will somehow help in restoring the water level in Angat Dam which for two weeks now is causing water shortage in certain Metropolitan areas. Second, the "NO CLASSES" declaration of President GMA last night saved me from reading almost 40 cases in Tax classes and an exam covering it's general principles and estate and donor's taxes. Third, I can stay at the office to finish paperworks which will fall due on Dec. 4 (Monday).

Last Monday (Nov. 27), I declared myself DRAINED and no more energy for the succeeding work/school days. An aftermath of a not so satisfying weekend I had and Civil Law Review Recitation days which for me resulted to an awful display of ignorance in front of Dean Aligada.

Now I have to thank God for this "rain" of blessings. After hearing the news from a friend, My energy level was regained and my hopes for better days next week were revived.

Enjoy your long weekend guys and make the most of the cold weather to hug your lovedones. It would probably be the last typhoon for year 2006.

Always a FIRST-TIMER in Dean Aligada's Class

After my satisfactory recitation in Crim Law Review (Nov 22), I hurriedly went to the office. I have to admit, I am not yet comfortable with my not so good schedule this semester. So that you may be able to understand my case, here are the facts: 3x a week I have to do this routine: Sta. Mesa-UST-OSG-UST-Sta. Mesa. That’s the hardship I’m going through by being an independent lawyer wannabe (cguro mapride din ako, ayaw magpatulong kay dad) .

It’s 3:45 PM and I’m still at the premises of OSG because I still have to prepare one more correspondence for my boss. I just hope I can reach UST by 4:10 so that I won’t be late for Civ Rev 2 class with Dean Aligada (Oh! I am 5 mins. late yesterday).

As expected, I am 10 mins late and I entered the room just in time he finished calling my name. Aggghh! I have to submit again a piece of paper stating my name and that I am late...Nagalit si Dean! (according to him he don’t care what time latecomers will leave home or workplace so long as in his class we should be there exactly 5:10).

OMG! I haven’t really studied for this class because I prepared too much for Dean Ortega’s class. Cross fingers and praying, I heard Dean Aligada called my name. As expected, I WILL BE RECITING for the second batch.

His question dealt with RECIPROCAL OBLIGATIONS vs. BILATERAL OBLIGATIONS. My answer was not good enough, again as expected.

I felt like a first timer again. First timer in reciting to my most revered professor in law school. (He is comparable to Prof. Keynes of “Love Story in Harvard”)

And I know I will be reciting daily except on Thursdays until the Christmas break..

Hay! I have to set-aside all things so that I can at least have a mark of “FAIR” in my card. I still remember what Dean Aligada told us way back in my first year in Law:

“You have to be extraordinarily intelligent before you can get a grade of 78 in my class. because in Civil Law, I am next to God.” - Dean Aligada

My Head’s Blowing, My Knee’s Shaking

November 21, 2006 is my first time to recite in Dean Carlos Ortega’s Criminal Law Review Class. My title explicitly told you what I feel exactly the moment he called my name.

Dean Ortega: Ms. Tornino, Claudette… Am I right?

Daye: Sir, it’s Tolentino

Dean Ortega: You’ve written your name very small, you cannot write this small when you take the bar, Ms. Tolentino

Daye: Yes sir. I am very sorry for that.

Dean Ortega: What is Error in Personae and it’s effect in the liability of the accused?

Daye: Error in Personae is an instance where the actual victim was not the intended victim of the offender, sir. The criminal liability of the offender will be governed by Art. 49 of the RPC, sir.

Dean Ortega: And what does Art. 49 provides?

Daye: The provision provides that if a graver offense was committed than what was actually intended by the offender, the penalty to be imposed shall that be of the penalty intended in it’s maximum period.

Dean Ortega: blah…blah…blah… (lecturing), What if the felony committed was lesser than what was actually intended?

Daye: Sir, Art. 49 will still apply.

Dean Ortega: Why?

Daye: Sir, it’s because Art 49 explicitly provides that if a graver offense was committed than what was actually intended by the offender, or vice versa, the penalty to be imposed shall that be of the penalty intended in it’s maximum period.

Dean Ortega: (gave a hypothetical question)

A intends to kill B
But instead of killing B,
He killed C, knowing that it was B.
C died.


If you are the judge, will you consider it error in personae? Would be the effect in his criminal liability.

Daye: Sir, it’s not error in personae.

Dean Ortega: It is clear from the problem that the actual victim was not the intended victim of the offender, isn’t it what you have defined as Error in Personae?

Daye: Ah sir, Error in Personae presupposes a graver or lesser offense resulted from the act. In the case you have given, the crime committed is still consummated homicide but in this case the crime was committed against C, therefore A will be liable for Homicide independently of his liability for trying to kill B. Therefore, Art. 49 will not apply.

Dean Ortega: In that case, your answer would be shorter if you have just told us, THERE WOULD BE NO EFFECT. (blah…blah…blah… Sermons on how to make your answers responsive to the question)

Sigh. One recitation down, I have a strong hunch that I will be called too in Civ Rev 2 class. My only consolation, Dean Ortega didn’t call me stupid. : )

Sunday(e)s

On Saturday nights my brain is busted and can’t function the way it does on weekdays. I envy my classmates who can read books on Saturday nights just because for four years now I do that only on exam or revalida period. The said brain state shall continue until 8pm of the following day and again I have to rush preparing for another long week of work, school and teaching.

I had the chance to go to the mall yesterday after watching the Pacquiao game. I am in no mood to study to study Civil Law and Criminal Law despite my great hunch that it will be my turn to recite this week. Sundays are always my sloth day.

It was window-shopping for me. I never really plan to buy something; I just want a break from house chores which kept me busy the whole Sunday morning. My Sundays have been devoted to laundry, general cleaning and cooking for my housemates, especially if I wasn't able to go home. My Sunday which is supposed to be the only rest day I have in a week is consumed doing chores which I can't normally do on work/school days.

The nearby mall was so busy. It doesn’t take note of my presence. Lots of families are now busy buying for Christmas celebration. I saw a very pretty mom buying her two kids Christmas dresses (it’s quite obvious because she paired the red dress and white shoes with a small aginaldo bag), I saw daddies buying toys and one grandfather who bought a doll for her granddaughter (there I miss my lolo again).

I went to the supermarket to buy some toiletries, coffee, cookies and chocolates and felt bored with that long line of shoppers buying keso de bola, hamon, and dessert ingredients (isn’t this too early for Noche Buena?). After an hour, I made through it.

Have decided to check on Christmas decors, it will be my surprise for Mom on the 25th of December when she arrives from the USA to celebrate Christmas day with us. My mom is an avid lover of Christmas decors and lights.

I took note of the time its 8:45 PM and I have to go home now. Tomorrow will be another day after another of so many things to accomplish. Can’t wait for another SUNDAY(e).

OMG! Classes will start soon!

Skul blues na naman ako...
Dami ko pa hindi nagagawa sa sembreak goals ko...
Darating na naman ang araw na kailangan kong magbasa
ng magbasa at magbasa pa ulit...
Ang mga araw na mas gusto mo matulog pero pipilitin mo
ang sarili mo magpuyat...
Mapapabayaan mo ang mga "vanity measures" at hindi
na naman makakapagsuklay at least 2x a day...
Ang mag-feeling superhero at talbugan si "Flash" sa
mabilis na takbo ng oras tuwing workdays.
Ang mapabayaan ang YM, Friendster at Blogs mo.
At higit sa lahat mula sa disco, comedy bars at walang
katapusang gimik mo tuwing Friday nights,
Sa pasukan, sa starbucks ka na lang, nagpapakalasing
sa kape habang nagbabasa ng sangkaterbang kaso at libro.

Sigh.

Isipin mo na lang lilipas din lahat ng paghihirap mo at
